Acceptance of Terms

These Terms and conditions apply between Im.photo (hereinafter Im.photo) and you (the member) where you will obtain membership at Im.photo’s website and you grant Iam.photo the right to display your uploaded photographs.

Please read these Terms carefully before using the services. By accessing the Iam.photo website you are agreeing to be bound by these Terms which govern our relationship with you in relation to the site. If you disagree with any part of the Terms then you may not access the site.

All rights to the Iam.photo in general and the use of network address (domain name) Iam.photo belong to the Iam.photo Administration.

1. Definitions

1.1. "Terms of use" (hereinafter Terms) means the terms and conditions below, to which you have agreed to be bound.

1.2. "Member" (or "you") means the individual or entity that has accepted and agreed to be bound by the Terms and conditions of this Agreement. Iam.photo is available only to individuals who are either at least 18 years old, or at least 14 years old, and who are authorized to access the Iam.photo by a parent or legal guardian. If you have authorized a minor to use the Iam.photo, you are responsible for the online conduct of such minor, and the consequences of any misuse of the Iam.photo by the minor.

1.3. "Iam.photo website" - is an online resource for network address iam.photo

2. The object of the Terms

2.1. Iam.photo is hereby granted the right to display Your Photograph(s), any written text and any other material or information, submitted by you to Iam.photo's website, any written text and any other material or information on its servers and backups. You will remain the copyright owner of Your Photograph(s).

2.2. Iam.photo is also granted the right to display share-buttons to social network sites below your Photograph(s).

2.3. Iam.photo is also granted the right to share Your Photograph(s) on social networks official pages of the Iam.photo.

2.4. Iam.photo is also granted the right to showcase Your Photograph(s) in emails related to Iam.photo activity.

3. Rights and warranties of the parties

3.1. You warrant that you are the copyright owner of Your Photograph(s) and that you have all necessary permits and sufficient rights in and to Your Photograph(s) to grant to Iam.photo. For avoidance of any doubt, if Your Photograph(s) is a montage, you warrant that you are the copyright owner and that you have all necessary permits and sufficient rights in and to all parts of Your Photograph(s) to grant Iam.photo.

3.2. You undertake to defend, at your own expense, Iam.photo against any claims from third parties alleging that Iam.photo's use of Your Photograph(s) in accordance with this Terms constitute an infringement of any rights of a third party (hereinafter referred to as "Claims") and to indemnify and hold Iam.photo harmless from any costs, damages, liabilities, and/or expenses (including reasonable legal fees) suffered or incurred by Iam.photo due to or arising from such Claims.

3.3. You warrant that you have all the necessary model releases and that you have obtained all the necessary approvals from persons that appear in Your Photograph(s) to grant to Iam.photo.

3.4. You warrant that Your Photograph(s) do not contain any illegal material and/or in themselves constitute illegal material.

3.5. You warrant that Your Photograph(s) do not contain anything that may constitute a violation of the personal integrity and privacy of an individual.

3.6. You warrant that Your Photograph(s) do not contain anything that may offend, slander, defame or discriminate any individual, entity or group of people.

3.7. You warrant that Your Photograph(s) do not contain any offensive or pornographic material.

3.8. You warrant that Your Photograph(s) do not contain any offensive material.

3.9. You warrant when placing materials on the Iam.photo from other sources is required to indicate the link back to this site.

3.10. You undertake to indemnify Iam.photo for any and all costs, losses and/or damages incurred by Iam.photo due to or arising from a breach of any of the warranties under this Terms.

3.11. You acknowledge and agree that if you fail to fulfill any of your undertakings under this Terms, Iam.photo might ban or delete your Account for a limited period of time or permanently.

4. Member's undertakings

4.1. You undertake to register a valid email address, phone number, address and your personal information when you create your account.

4.2. You warrant that you are the author of all of Your Photograph(s) and if Your Photograph(s) is a montage, that you are the author of all parts of Your Photograph(s). You are not allowed to upload photographs to Iam.photo's website, which someone else is the original author of, for example stock photography or creative commons material, or use such material in any part of Your Photograph(s). If in doubt, Iam.photo might request original source files or negative scans from you to verify that you are the author of Your Photograph(s).

4.3. You undertake to only register one account at Iam.photo's website. If your Account has been banned or if you have lost your username or password and for any other reason, you are not allowed to register a new account, without the consent of Iam.photo.

4.4. You undertake to keep your password safe and never share it with anyone or write it down. Iam.photo staff will never ask for your password. If you have lost your password you are able to reset it.

4.5. You warrant that the country you have selected in your “Account settings”-page on Iam.photo's website is the country you actually reside in.

4.6. All photos uploaded to Iam.photo must have artistic merit, quality and purpose. Iam.photo is only intended for artistic photography, it is not an image hosting site for any kind of images, snapshots, family album photos and photos lacking artistic quality are prohibited and may be deleted by the staff of Iam.photo as decided by Iam.photo's staff in its sole discretion.

4.7.  It is strictly prohibited to advertise products, services, other sites, companies or causes on Iam.photo's website or contact our members in order to do so, without the written consent of Iam.photo. It is also prohibited to contact our members with offers, to make them join other sites or organizations or donate money, without the consent of Iam.photo.  

 4.8. When communicating on Iam.photo, in all forms of communication always use a friendly, polite language. Never write in anger, insult, and slander, defame, offend, discriminate or make personal accusations or attacks against someone. Never use a rude language. When commenting on another member's photo(s) you are required to be extra careful. Insulting, offending, slandering, defaming or discriminating someone for any reason is strictly prohibited. When writing in critique, you must give useful, constructive tips on how to improve the photo you are commenting. Failure to follow the rules may lead to deletion of individual critique posts, deletion of images posted.

5. Iam.photo's undertakings

5.1 Iam.photo undertakes to acknowledge and identify you as the author of Your Photograph(s). Such acknowledgement will be made on Iam.photo's website and on social network sites.

5.2 Iam.photo undertakes to not to share your personal information with anyone who is not a member of its staff or a subcontractor or partner of Iam.photo, without your consent.

5.3 You acknowledge and agree that Iam.photo and its staff have the right to delete any written message or other text or material submitted by you at any time and for any reason.

6. Personal information

6.1. You agree that your personal information, including, but not limited to your full name, username, email, phone number, address, text, profile photo, photos, private messages, chat conversations, public comments, forum posts and information on your profile-page, will be stored on our servers and in our databases.

7. Liability and limitation thereof

7.1. Iam.photo is relieved from liability from any consequences of hacker attacks or otherwise unauthorized access to their servers or databases or any consequences of errors or faults in Iam.photo's website, which results in a third party's possession or spreading of any personal information, photograph(s), image file(s) or other material or information.

7.2. Iam.photo is relieved from liability from any consequences of any illegal, slandering, offending, discriminating or defamatory comments or other material provided by its members. You are personally responsible for any such comments or material that you submit to Iam.photo's website.

7.3. Iam.photo is relieved from liability for a failure to perform an obligation under this Terms if such failure is due to a circumstance of the type stated below (Relieving circumstance) and the circumstance prevents or makes substantially more difficult the timely performance of such obligation. A Relieving circumstance shall be deemed to include inter alia acts or omissions of authorities, new or amended legislation, leaving of personnel, illness or other reduction of work capacity, death, conflicts on the labor market, blockade, fire, flood, war, loss or destruction of property or data of major significance or a major accident.

8. Changes

8.1. These Terms shall enter into force on the date of registration of the User on the Site and User accession to these Terms and shall be valid for an indefinite period.

8.2. Iam.photo has the right to unilaterally change the provisions of the Terms; the user can be notified of their technical means on the site.
